Terms of Service
These Terms of Service ("Terms") govern your access to and use of the mobile application, website, content, products, and services (collectively, the "Services") provided by AGB Communication Co., Ltd ("Company," "we," "us," or "our").
By accessing or using the Services, you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you regarding the Services.
1. Scope of Service
Our App provides a platform that connects passengers with independent drivers. Drivers register on our platform to offer transport services independently (either in person or through a business entity). Our App displays an estimated fixed price for each requested route to serve as a baseline. The passenger and the driver are free to negotiate and agree on the final trip price. Our App only facilitates the initial connection and price estimation; we are not a party to the transport agreement between the passenger and the driver, and we are not responsible for the fulfillment or quality of the transport service.
1.2 Pricing and Direct Payment
You enter into a direct agreement with the driver for the transport service. The final agreed price, along with any applicable tolls or surcharges, must be paid directly to the driver in cash or through another mutually agreed payment method. There is no in-app payment functionality. Any tips are strictly optional and paid directly to the driver.
1.3 Safety and Information Sharing
Passengers may use the App's built-in sharing features to send driver details and real-time trip information to external contacts for safety or coordination purposes. Driver data relevant to your journey will remain accessible within the App during and after the trip.
1.4 Driver Account Controls
Registered drivers manage their availability independently through the App. Drivers retain full control to start, pause, stop, or cancel their availability or specific trip requests at their discretion, subject to our community standards.
2. User Eligibility & Account Registration
2.1 Passenger Registration
To use the Services, you must register for and maintain an active personal user account ("Account"). You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to establish an Account.
2.2 Account Security
You are responsible for maintaining the confidentiality of your Account login credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.
3. Passenger Ride-Hailing Terms
3.1 Requests & Cancellations
Upon requesting a ride, the platform will match you with a Driver based on proximity and availability. You may cancel a ride request prior to Driver arrival.
3.2 Code of Conduct
Passengers must treat Drivers and their vehicles with respect. You strictly agree NOT to:
- Consume alcohol or illegal substances during the ride (unless permitted by local laws for specific luxury charters).
- Smoke, vape, or use e-cigarettes inside the vehicle.
- Transport hazardous materials, firearms, or illegal contraband.
- Exceed the legal passenger seating capacity of the vehicle.
3.3 Cleaning & Damage Fees
Passengers shall be liable for the cost of repair for damage to, or necessary cleaning of, Driver vehicles resulting from use of the Services under your Account in excess of normal "wear and tear." A minimum cleaning fee of “MMK” may be charged automatically to your payment method upon verification of physical damage or excessive mess caused by you.

5. Limitation of Liability
5.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE COMPANY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
5.2 Limitation of Liability
THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, REGARDLESS OF THE NEGLIGENCE OF THE COMPANY.
6. Termination & Account Suspension
The Company reserves the right, in its sole discretion, to suspend or terminate your Account and access to the Services at any time, with or without notice, for conduct that the Company believes violates these Terms, harms other users, or damages the commercial reputation of the platform.
7. Amendment to General Terms and Conditions
If any amendments are made to these Terms, we will notify you of material changes by posting the updated policy within the app or via email prior to the changes taking effect. If you continue using Tu Tu Go App, you will be deemed to accept the amendments.
